Identification
Clients must present a valid form of identification, such as a driver's license, passport, or government-issued non-driver ID, when signing a document. The ID must be current or expired within the last three years. If the notary knows the client personally, they may not need to see identification.
Document understanding
Notaries should ensure that clients understand the document they are signing and are willing to do so. If the client has questions, the notary can refer them to an attorney. If the client is blind, illiterate, or doesn't speak English, the notary may need to read the document to them or translate it.
Oaths
Notaries may be asked to administer oaths for depositions in court cases or investigations. When doing so, they must require the deponent to be present and properly identify themselves.
Invoices
Notaries may require clients to pay fees before releasing completed documentation. If clients don't pay, the notary may decline to continue working with them or put a lien on any documents they have.
